1. Purpose and Acceptance of Terms

1.1 LunchUp helps schools, families, and vendors manage school lunch programs, fundraising, and hardship-meal donations.

1.2 By using LunchUp.ca, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use our services.

2. Description of Service

2.1 LunchUp.ca is a meal ordering platform that facilitates lunch orders for students in participating schools.

2.2 We connect parents/guardians with approved vendors to provide nutritious meals for students.

3. Parent and User Responsibilities

3.1 Parents/guardians must:

  • Provide accurate student information (name, allergies, class).
  • Review menus carefully before ordering.
  • Ensure payment details are correct and sufficient.

3.2 All users must:

  • Provide accurate and complete account information.
  • Keep account information up to date.
  • Safeguard login credentials and notify us of unauthorized use.
  • Use the service only for lawful purposes.

4. Platform Services

4.1 Schools and vendors are solely responsible for the quality, preparation, and delivery of food.

4.2 LunchUp.ca provides the technology platform, payment processing, and customer support.

5. Payments and Refunds

5.1 All orders must be paid for in advance. Payments are processed securely through PCI-compliant processors.

5.2 Refunds for cancelled orders will be issued to your LunchUp Credit account, following deadlines and policies set by schools and vendors.

5.3 Credit and refund handling will follow school/vendor policies and may vary between programs.

6. Cancellation Policy

6.1 Orders may be cancelled according to the deadlines set by individual schools and vendors.

6.2 Refunds will be credited to your LunchUp Credit account in accordance with the cancellation policy.

7. Allergy and Dietary Information

7.1 LunchUp provides allergy and dietary information from vendors where available.

7.2 Parents/guardians are responsible for confirming that meals are suitable for their child's needs, especially in cases of severe allergies.

7.3 Direct communication with the school and vendor is strongly recommended for allergy concerns.

8. Privacy and Data Security

8.1 We comply with Canadian privacy laws, including PIPEDA.

8.2 You are responsible for safeguarding your login credentials.

8.3 Please review our Privacy Policy for details on how we collect, use, and protect personal information.

9. Email and Communication Consent

9.1 By using the platform, you consent to receive transactional emails such as order confirmations and receipts.

9.2 You also consent to receive updates and promotional offers. You may unsubscribe from promotional emails at any time.

10. Limitation of Liability

10.1 LunchUp.ca acts only as a platform connecting users with vendors and schools.

10.2 We are not liable for food quality, safety, delivery, or suitability of meals.

10.3 Liability is limited to the lesser of:

  • The amount paid for the specific order in question, or
  • Payments made in the last six (6) months.

11. Changes to Terms

11.1 We may update these Terms of Use from time to time.

11.2 Updated terms will be effective upon posting on our website. Significant changes will be communicated to users.

12. Governing Law

12.1 These Terms of Use are governed by the laws of Canada.

12.2 For schools located in Ontario, these Terms are governed by the laws of Ontario, Canada.
